Entity: Agivant Technologies Inc. • Last updated: October 20, 2026

These Terms of Use (“Terms”) apply to your access to and use of www.agivant.com (the “Website”), operated by Agivant Technologies Inc. and its affiliated entities (collectively, “Agivant,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

The Website is provided for general business and informational purposes. Services, software, products, statements of work, and deliverables provided to a client are governed by the applicable signed agreement. If these Terms conflict with a signed client agreement, the signed agreement controls with respect to the services covered by that agreement.

If you accept these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

Agivant Technologies Inc. is incorporated in the State of Delaware, with offices at 84 W Santa Clara St, San Jose, CA 95113, USA.

1. Acceptable use

You may use the Website only for lawful purposes and in accordance with these Terms. You must not, and must not attempt to:

  • Interfere with, disrupt, damage, or impair the Website or its operation, or place an unreasonable load on it;
  • Upload, transmit, or introduce malware, malicious code, or other harmful material;
  • Gain unauthorized access to the Website, its systems, accounts, or related infrastructure;
  • Misrepresent your identity, impersonate another person or organization, or make misleading statements about your affiliation;
  • Use scraping, harvesting, crawling, or other automated means to collect Website content or information without authorization, except as permitted by applicable law; or
  • Use Website content to train, fine-tune, evaluate, or otherwise develop machine learning or artificial intelligence models without our prior written permission.

We may monitor Website activity to the extent permitted by law and may suspend, restrict, or block access where reasonably necessary to protect the Website, our users, or our business.

2. Intellectual property

Unless otherwise stated, the Website and its content, including text, graphics, designs, images, materials, and the Agivant and Amp’d names and logos, are owned by Agivant or used with permission and are protected by applicable intellectual property laws. Partner, platform, and product names and marks belong to their respective owners and are used to identify or describe relevant technologies.

You may view and download Website materials for your internal business evaluation, provided you retain all copyright, trademark, and other proprietary notices. Any other reproduction, modification, distribution, public display, publication, or commercial use requires our prior written permission. Except for the limited use expressly permitted in these Terms, no license or other intellectual property right is granted to you.

Software and other materials made available for download with their own license terms are governed by those terms. Failure to comply with these Terms terminates the rights granted above without notice, and you must then destroy all copies of downloaded materials in your possession or control.

3. Website information and results

Website content is provided for general informational purposes only. It does not constitute professional, legal, financial, technical, or other advice, and it does not constitute a binding offer or commitment by Agivant.

Case studies, metrics, examples, and descriptions of past work reflect specific circumstances and are illustrative only. They do not guarantee that similar results will be achieved in other circumstances. Client names and identifying details are anonymized unless their use has been approved in writing. Descriptions of AI agents, tools, or solutions are informational and do not create access to, or an entitlement to, any product or service.

Agivant has business relationships with clients, partners, suppliers, and others. Words such as partner, partnership, alliance, and joint venture are used on the Website to describe business relationships involving common activities and interests, and may not indicate a precise legal relationship.

Articles, blogs, and opinion pieces published on the Website by individuals, including Agivant employees, represent the views of those individuals and may not represent an official position of Agivant. Agivant retains copyright in that content.

4. Your submissions and privacy

When submitting information through the Website, you agree to provide information that is accurate and that you are authorized to share. Do not submit passwords, payment card details, sensitive personal information, confidential client information, source code, or other restricted or proprietary material through Website forms unless we have expressly authorized that submission through an appropriate channel.

Agivant does not accept confidential or proprietary information through the Website. Information or material you send through the Website is deemed non-confidential unless we have separately agreed otherwise in writing. Submitting an inquiry, resume, feedback, or other material does not create a client, advisory, employment, or other contractual relationship with Agivant. To the extent permitted by law, we may use feedback, suggestions, ideas, concepts, know-how, or techniques you voluntarily provide without payment or attribution. We will not publicize the fact that you submitted material to us unless you permit it, we notify you in advance, or we are required to do so by law.

Our Privacy Policy describes how we collect, use, disclose, and otherwise process personal information. Please review it before submitting personal information through the Website.

5. Careers and recruitment

Information about employment opportunities is published through our official careers page and our official LinkedIn page. We do not warrant that the Website will be accurate, complete, secure, uninterrupted, timely, or error free, or that defects will be corrected.

To the maximum extent permitted by applicable law, Agivant will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your access to or use of the Website. Our total aggregate liability arising out of or related to the Website will not exceed one hundred US dollars (US $100).
